Indonesian Patent Office – Unpaid Patent Annual Fee in Indonesia

For more than 14 years since August 2001, the Indonesian Patent Law has governed patent annual fee in that if a patent holder does not pay the required patent annual fee for a period of three consecutive years, the patent will then be deemed void starting at the end of the third year. Normally, a written request from the patent holder to the Indonesian Patent Office is required to abandon a patent. However, this provision has not been strictly enforced and the Indonesian Patent Office routinely allows patent holders to passively abandon their patents.

 

But over the past two years, the Indonesian Patent Office has begun to enforce a provision of the Indonesian Patent Law stating that annual fees that are not paid in three years are debt that must be paid by the Patent Holder. Although, no sanctions or other penalties have been imposed against the patent holder over such unpaid debts now; however, it could change in the future should the Indonesian government attempt to enforce this provision more vigorously.
